Bio Pure Pharmaceutical Clamps

            A major part of Bio Pure’s business is in clamps for joining together pipework in pharmaceutical apparatus.   This may sound unglamorous until it is remembered that pharmaceutical preparations are amongst the most expensive liquids of all.  The slightest contamination can  ruin an entire batch.

            Roy Maunder of Bio Pure knew the cost of conventional metal clamps and had a shrewd suspicion that he could provide as effective a clamp in plastic material.  These clamps act by pulling seal faces backed by conical surfaces towards each other.  The clamps have complementary conical faces.  Roy improved the design of the clamps to enable them to work when made of plastics materials.  We filed patent applications.

            Not being a plastics expert, he sought and found a potential manufacturer.  Everything appeared to be well with the project until Roy found to his horror that the manufacturer had applied for his own patent application, in an effort to have control over Roy’s project.  Roy was not for that and we filed an entitlement action in the Patent Office.  The outcome was a decision that Bio Pure was entitled not only to the British Patent but to overseas patents as well.

            Would that this was the end of the unwelcome attention that Roy’s brainchild attracted.  Sadly, it was not.  A US distributor took one of Roy’s clamps to India and had a set of moulds made there.  Copies began to appear on the US market.  This was too much for Roy, who asked us to arrange for patent infringement action to be taken, not only under his original patent but also under the patent he had acquired as a result of the entitlement action.  There is some poetic justice!!

            The traditional view of US patent infringement action is “Don’t touch it with a barge pole, it will ruin you”.  I am happy to say that Gary Lambert of Lambert Associates in Boston – please see www.lambertpatentlaw.com – was able to file an affordable action, which the defendant had the good sense not to seriously contest.  The result was a damages award to Bio Pure.
